Description of Member's Practice: Our employment law practice group has been recognized as one of the leading practices in the country in the Legal 500-Asia Pacific guide. We advise on the applicability of legislations governing social security, long-term benefits, employee insurance, disability benefits, payment of bonuses, engaging of apprentices, maternity benefits and implementation of DEI mandates. Additionally, we provide advice on issues such as compensation structure and employees stock options schemes, secondment of foreign employees in India, termination and workforce reduction, disciplinary proceedings, retrenchment, and restructuring pursuant to mergers, acquisitions, and transfer of business. We support our client’s business teams in post-transaction integration of the workforce, including the transfer of employees seamlessly from one entity to the other. We also advise on disputes with employees and former employees, including in mediation proceedings, and representation before Labour Tribunals, and other civil and criminal courts. The firm supports and conducts investigations into allegations of misconduct, fraud, corruption, embezzlement, leakage of sensitive information, kickbacks from vendors to employees; policy violations, and related issues. Further, the firm regularly assists in inquiries relating to workplace harassment and conducts anti-sexual harassment workshops for its clients. We also conduct an assessment of compliance and training programs for Indian subsidiaries and joint ventures of multinational companies, to ensure that the employees are sensitized about compliance with local as well as foreign anti-bribery legislations such as FCPA, UK Bribery Act, and Sapin-II law.
